Summer Night Concert 2024 - Giveaway Terms & Conditions

1. You agree that by participating in the StoneX Bullion Giveaway (the “Giveaway”) you will be bound by these terms and conditions (the “Giveaway Terms”).
2. This Giveaway is offered by StoneX Bullion GmbH (“StoneX”, “we”, “our” or “us”) a company registered in Germany, with registered office at Taunustor 1, 60310 Frankfurt am Main, Germany and entered in the commercial register of the Local Court of Frankfurt under registration number HRB 98020.
3. To be eligible to participate in this Giveaway you must satisfy the following conditions:
   1. be over eighteen (18) years of age;
   2. be a resident of Germany or Austria;
   3. correctly enter the Giveaway by either:
      1. if you are an existing customer of StoneX, receive an email from us and complete the entrance form; or
      2. completing the entrance form accessed on www.stonexbullion.com with your details and click where indicated. Any individual who satisfies all of the criteria above shall be deemed a “Qualifying Applicant”.
4. All Qualifying Applicants will be entered into a prize draw. Each winner will receive flights to Vienna and a hotel reservation (with breakfast) at DoubleTree by Hilton Vienna Schönbrunn for two people so that each winner and their guest can attend the Wiener Philharmoniker Summer Night Concert 2024 https://www.wienerphilharmoniker.at/en/summernightconcert(the “Prize”). The winner will receive two tickets for the concert. The hotel reservation for one double room for two nights (7^th June 2024 – 9^thJune 2024) will be made directly with the hotel and we will provide reservation details to each winner.
5. StoneX will reimburse each winner for return flights from the international airport of their choice in Germany or Austria up to a maximum of EUR 300 per return ticket (two for each winner). The outward and return flights must be direct to Vienna and must be economy tickets. The winner and their guest must be booked onto the same flight in the same booking. Each winner must book their flights by 31^st May 2024 and provide the booking confirmation to us following which we will reimburse each winner up to a maximum of EUR 300 per return ticket within 30 days of receipt of the booking confirmation and their bank details. We will not be responsible for any other costs or expenses related to each winner’s and their guest’s attendance at the concert such as meals (other than breakfast included with the hotel booking), drinks, airport transfers or other transport.
6. We reserve the right to substitute the Prize for a prize of equal or greater value. The Prize is not negotiable or transferable and there is no cash alternative.
7. Qualifying Applicants are deemed to have accepted and agreed to be bound by these Giveaway Terms upon entry.
8. The Giveaway opens on 8^thMay 2024 at 00:01 CET and closes on 17^th May 2024 at 23:59 CET (the “Entry Period”). Entries received before or after the Entry Period will not be eligible for the Prize.
9. There will be two winners who will be selected at random from all valid entries after the closing date by a computer process that produces verifiable random results.
10. We will contact the winners by email, using the email address provided in their entry form, within 3 days of the closing date. We will make reasonable efforts to contact the winners but if they do not claim their Prize (by providing us with proof of their residence in either Germany or Austria and their postal address) within 3 days of us first notifying them we shall have the option to select an alternative winner.
11. The winners agree to take part in reasonable publicity relating to the Giveaway and we may use the winner's name and his/her comments relating to the Giveaway and/or the Prize for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid.
12. Only one entry per Qualifying Applicant is permitted. Additional entries will not be considered or responded to.
13. Entries that are incomplete, delayed, not received for whatever reason or not in accordance with these Giveaway Terms will not be accepted.
14. We shall not be liable for any failings, disruptions or cancellations caused to the Prize unless these are caused by our negligence.
15. Any personal data relating to the winner or any other entrants will be used by us solely in accordance with our privacy policy and for the purposes of administering the promotion and awarding the Prize. The winner must ensure they have the consent of their guest before providing the personal data of their guest to us to allow us to administer the Prize. Each winner’s details and those of their guests will be passed to the hotel to book their rooms and to the Münze Österreich (StoneX’s partner) for arrangement of the tickets. The hotel booking will be subject to the hotel’s terms and conditions.
16. Notwithstanding any other provision of these Giveaway Terms, we shall have the sole discretion to determine your eligibility under these Giveaway Terms, including, without limitation, whether or not you are a Qualifying Applicant. We have the right not to accept a Qualifying Applicant for any reason or without reason as we shall determine in our sole discretion.
17. Our employees or other producers or suppliers associated with this Giveaway, their advertising, printing and publicity agencies, and their immediate family members (i.e. any person residing in the household of the aforementioned people) will not be eligible to participate in the Giveaway.
18. We reserve the right at our sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Giveaway, or who breaches the Giveaway Terms.
19. We reserve the right to alter, amend or terminate this Giveaway, or any aspect of it, at any time and without prior notice. We may make changes to these Giveaway Terms and will notify you of these changes by posting the modified terms on our website. We recommend you revisit these Giveaway Terms regularly, and by your continued use of our services you accept any such modified terms.
20. Any dispute or situation not covered by these Giveaway Terms will be resolved by our management in a manner it deems to be the fairest to all concerned, and that decision shall be final and/or binding on all entrants. No correspondence will be entered into.
21. If these Giveaway Terms are translated into a language other than English, then the English version of the Giveaway Terms shall prevail where there is an inconsistency.
22. If any term of these Giveaway Terms is found to be illegal, invalid or unenforceable under any applicable law, such term shall, insofar as it is severable from the remaining terms, be deemed omitted from these Giveaway Terms and shall in no way affect the legality, validity or enforceability of the remaining terms.
23. This Giveaway and these Giveaway Terms are governed by the law of Germany and the courts of Germany shall have non-exclusive jurisdiction over any matter or dispute arising from this Giveaway or the Giveaway Terms.
